SHIFFTO TERMS OF SERVICE

Welcome to SHIFFTO. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and Shiffto Pty Ltd (“SHIFFTO”, “we”, “us”, or “our”).

These Terms govern your access to and use of our website, web platform, mobile applications, marketplace, and related services (collectively, the “Platform”).

By creating an account, browsing our website, or using any feature of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately cease accessing or using the Platform.

SHIFFTO operates an online peer-to-peer technology platform that connects individuals who wish to send parcels or documents internationally or domestically (“Senders”) with verified individuals who are travelling along compatible routes and have luggage or transit capacity (“Travelers”) or independent third-party transport providers (“Carriers”).

SHIFFTO is a marketplace and technology facilitator. Unless explicitly stated otherwise in writing:

• SHIFFTO does not directly provide freight forwarding, transportation, courier, or delivery services;
• SHIFFTO does not own, possess, inspect, pack, store, or physically take custody of parcels;
• Agreements for parcel carriage, delivery timing, handover, and fees are entered into directly between the Sender and the Traveler or Carrier; and
• SHIFFTO acts solely as an intermediary facilitating matching, communication, and secure payment processing.

To register an account and use the Platform, you must:

• Be at least 18 years of age (or the legal age of majority in your jurisdiction);
• Have the legal capacity to enter into binding legal agreements;
• Provide true, accurate, current, and complete registration information; and
• Not be prohibited or sanctioned from using the Platform under any applicable domestic or international trade, transport, or anti-money laundering laws.

You are solely responsible for maintaining the confidentiality of your account credentials, passwords, and two-factor authentication access. You agree to notify SHIFFTO immediately of any unauthorized access to or use of your account.

For community safety, fraud prevention, and regulatory compliance, SHIFFTO enforces identity verification and Know Your Customer (“KYC”) procedures.

Users, particularly Travelers and high-volume Senders, may be required to submit:

• Government-issued photographic identification (passport, national ID, or driver’s license);
• A live biometric selfie or facial scan for verification matching;
• Proof of travel (such as confirmed airline tickets, flight booking references, or boarding passes);
• Proof of address or contact verification (phone number and email confirmation).

SHIFFTO reserves the right to decline verification, suspend accounts, cancel unverified trips or shipments, and withhold transaction payouts until identity verification has been completed to our satisfaction.

When creating a shipment request on SHIFFTO, Senders expressly warrant and represent that:

• All package descriptions, dimensions, weights, categories, and declared values are completely truthful, accurate, and not misleading;
• The parcel does not contain any prohibited, hazardous, flammable, illegal, or restricted goods as defined in Section 7 of these Terms;
• The parcel is securely and properly packaged to withstand normal travel and handling conditions;
• The item has been legally acquired and the Sender has full legal ownership or authorization to transfer the item;
• The Sender or designated recipient will be present, available, and responsive at the agreed handover and delivery times and locations; and
• The Sender is solely responsible for verifying and complying with all relevant customs declarations, duties, taxes, and import/export regulations applicable to the route.

When offering to carry a parcel or accepting a shipment request, Travelers agree that:

• They possess a valid travel ticket and genuine intent to complete the journey on the stated dates;
• They have the right to inspect all contents of any package in the presence of the Sender before accepting custody;
• They must never accept sealed, opaque, or locked packages without viewing and verifying their inner contents;
• They will keep the package safe, dry, secure, and under their personal control at all times during transit;
• They will adhere to all airline, airport security, and border border-control luggage rules and weight allowances; and
• They will deliver the package promptly upon arrival to the verified recipient, recording photographic or security code proof of delivery through the Platform.

Under no circumstances may any User request or transport the following items through the SHIFFTO Platform:

• Illegal drugs, narcotics, controlled substances, and prescription medications without prescription;
• Weapons, firearms, ammunition, knives, explosives, fireworks, or combat gear;
• Flammable, corrosive, toxic, radioactive, or bio-hazardous materials;
• Loose lithium-ion batteries or recall-flagged battery devices;
• Cash, currency, precious bullion, negotiable instruments, or uncrossed bearer checks;
• Counterfeit goods, pirated media, or goods infringing intellectual property rights;
• Live animals, protected wildlife, ivory, or restricted agricultural and animal products;
• Perishable food items subject to strict border quarantine prohibitions; and
• Any item whose possession, export, or import is prohibited by law in origin, transit, or destination countries.

Violations will result in immediate permanent account termination, forfeiture of payouts, and immediate referral to relevant law enforcement and aviation security authorities.

To protect both parties, all physical transfers must be recorded through the SHIFFTO Platform:

• Package Handover: At initial package handover, both the Sender and Traveler must confirm the exchange in the app, inspect the items, and capture clear photographs documenting the parcel’s physical state.
• Transit Updates: Travelers should update tracking milestones (departure, arrival, out for delivery) through the Platform so Senders can monitor journey progress.
• Final Delivery Confirmation: The designated recipient must provide the secure delivery PIN or confirm handover in the Platform. Once validated, the shipment status is marked completed and delivery fee release is triggered.

Delivery fees are agreed upon between the Sender and Traveler, subject to minimum thresholds and SHIFFTO platform service fees.

• Escrow / Payment Hold: Upon accepting an offer, the Sender pays the full agreed amount (delivery fee plus SHIFFTO service fee). Funds are securely held via our payment processing partners (including Stripe).
• Payout Release: Payouts to the Traveler are released following verified and successful delivery confirmation, minus applicable processing and platform service commission fees.
• Currency & Exchange: Transactions are processed in specified supported currencies. Exchange rates and international card conversion fees are handled by the card issuer or payment processor.
• Taxes: Users are solely responsible for calculating and remitting any personal income taxes, GST, or VAT arising from their earnings or use of the Platform.

Cancellations are subject to the following rules depending on when the cancellation occurs:

• Prior to Handover (Sender Cancellation): A full refund of the delivery fee is granted if cancelled before the Traveler accepts physical custody. A nominal platform administrative fee may apply.
• Prior to Handover (Traveler Cancellation): If a Traveler cancels a trip or is unable to take the shipment, the Sender receives a full 100% refund, and SHIFFTO helps re-match the shipment if possible.
• After Handover: Once a package is handed over, the transaction cannot be unilaterally cancelled. If a Traveler cannot complete delivery due to force majeure or emergency, the package must be safely returned to the Sender or an authorized collection point.

In the event of lost, damaged, delayed, or disputed parcels, Users agree to first utilize SHIFFTO’s built-in dispute resolution center.

Dispute procedures require:

• Submission of a dispute notice within 48 hours of scheduled delivery or incident occurrence;
• Clear photographic and documentation evidence from handover and delivery; and
• Cooperation in good faith with SHIFFTO support representatives.

SHIFFTO’s dispute determinations regarding fee withholding, refunds, or distribution from escrow are final and binding within the Platform. Users retain their statutory legal rights under applicable consumer protection legislation.

Cross-border travel and parcel transport involve customs and import regulations in multiple jurisdictions.

Users expressly agree that:

• The Sender is solely responsible for ensuring any customs declarations, import permits, or value declarations are complete and lawful;
• Any customs duties, tariffs, VAT, taxes, or inspection penalties levied by border authorities are the sole responsibility of the Sender;
• Travelers are not responsible for customs duties unless such duties resulted directly from a Traveler failing to present declarations provided by the Sender; and
• SHIFFTO assumes no liability for goods delayed, confiscated, seized, or destroyed by customs or border authorities.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SHIFFTO PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

IN NO EVENT SHALL SHIFFTO PTY LTD, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR PERSONAL PROPERTY ARISING FROM OR CONNECTED WITH YOUR USE OF THE PLATFORM OR ANY TRANSACTIONS FACILITATED BETWEEN USERS.

WHERE STATUTORY CONSUMER GUARANTEES CANNOT BE EXCLUDED (SUCH AS UNDER THE AUSTRALIAN CONSUMER LAW), SHIFFTO’S MAXIMUM AGGREGATE LIABILITY SHALL BE LIMITED TO RESUPPLYING THE SERVICES OR REFUNDING THE PLATFORM SERVICE FEES PAID FOR THE SPECIFIC TRANSACTION IN DISPUTE.

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Australia, without giving effect to any conflict of law principles.

Where services or activities involve operations in Bangladesh, the parties also acknowledge and respect applicable local statutory requirements, including the Personal Data Protection Act 2026 of Bangladesh and relevant trade regulations.

Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the competent courts of Australia, except where mandatory consumer laws grant you the right to commence proceedings in your local jurisdiction.

We may modify or update these Terms periodically to reflect changes in our services, applicable legal obligations, or platform improvements. When updates occur, we will revise the “Last Updated” date at the top of this document. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
